Northern Myst Creations reserves the right at any time and from time to time, to modify or discontinue, temporarily or permanently, the Web Site and any and all features and sections contained therein with notice to registered users provided via posting to the Web Site or email, and immediately in the event of technical difficulties.  Northern Myst Creations shall not be liable to any User or to any third party for any such modification, suspension, or discontinuance.

INDEMNITY

User agrees to defend, indemnify, and hold harmless Northern Myst Creations, its officers, directors, employees, and agents from and  against any claims, actions, or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from any use of the Web Site and and Material contained therein by User or through User's account, or by User's breach of the terms of this Agreement.  Northern Myst Creations shall provide notice to User promptly of any such claim, suit, or proceeding and shall assist User, at User's expense, in defending any such claim, suit proceeding.  Northern Myst Creastions reserves the right , at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by User. 

EXCLUSION OF LIABILITY

In no event will Northern Myst Creations be liable for any damages, including without limitation, direct or indirect, special, incidental, moral or consequential damages, loss of profits, opportunities or information or for expenses arising in connection with this Web Site, any software algorithms available on this Web Site, nor with any hyper-linked web site by interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if Northern Myst Creations is advised of the possibility of such damages, losses or expenses.  Software algorithms made available and hyperlinks to other internet resources are at your own risk.  The content, accuracy, opinions, expressed and other links provided by these software algorithyms and resources are not investigated, verified, monitored, or endorsed by Northern Myst Creations.

NO UNLAWFUL OR PROHIBITED USE

As a condition of your use of this Web Site, you warrant Northern Myst creations that you will not use this Web Site for any purpose this is unlawful or prohibited by these terms, conditions, and notices.  Although Northern Myst Creations may from time to time monitor or review transmissions, postings, and the like on this Web Site, Northern Myst  Creations is under no obligation to do so and assumes no responsibility or liability arising from the content of any such locations nor for any error, defamation, libel, slander, omission, falsehood, obscenity, pornography, profanity, danger, or inaccuracy contained in any information within such locations on the Web Site.  You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, scandalous, inflammatory, pornographic, or profane material or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.  Northern Myst Creations will fully cooperate with any law enforcement authorities or court order requesting or directing Northern Myst Creations to disclose the identity of anyone posting any such information or materials. 

MEMBER ACCOUNT, PASSWORD, AND SECURITY

If any of of the services requires you to open an account, you must complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form.  You also will choose a password and a user name.  You are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account.  You agree to notify Company immediately of any unauthorized use of your account or any other breach of security.  Company will not be liable for any loss that you may incur as a result of someone else using your password.  You may not use anyone else's account at any time, without the permission of the account holder. 

COMMUNICATION

Northern Myst Creations reserves the right to send User's electronic mail for the purpose of informing Members of changes or additions to the Web Site, this Agreement and any other service provided by Northern Myst Creations. 

COMMUNICATIONS THROUGH THE WEB SITE

In no event shall any communication made through the use of this Web Site's email and messaging functions constitute legal notice to the Company, or to any of its officers, employees, agents, or representatives constitutes  (including but not limited to legal notice required by federal, state, or local laws, rules or regulations) with respect to any existing or potential claim or cause of action against the Company or any of its officers, employees, agents, or representatives.

DISCLAIMER FOR THE USE OF PAY PAL SERVICES

In addition to the preceding terms and conditions the Company, its officers, employees, agents, representatives, shall not be liable for any damages of any kind arising from your use of the online pay-pal service, including any non-authorization of a user's payment by any entity involved in the processing of any online transaction including but not limited to your credit card company, any applicable governmental authority's non-acceptance of a payment form an online bill-pay user, or for any disruptions in service of the online bill-pay service regardless of cause.  The Company further assumes no responsibility for the timeliness, deletion, mis-delivery, or failure to store any user communications of personalization settings. 

Completion of a payment transaction using the online pay-pal service is contingent upon:  1) the authorization of the payment by all entities involved in the processing of any online transaction including your applicable funding source;  2.) the acceptance of your payment or other entity you are attempting to pay and; 3) payment of the online pay-pal transaction fee, if applicable.  If for any reason whatsoever your payment is not processed, authorized, or accepted by any entity involved int he processing of any online payment transaction, or if where  applicable, any entity fails to accept your payment, your payment liability shall remain outstanding and unpaid and you may be subject to late fees interest charges, penalties, or other actions where applicable.  All outstanding payment obligations shall remain your sole responsibility.  You understand, accept, and agree to pay the Company any and all fees and/or penalties associated with the submission of any payment transaction that is returned by any bank or other depository financial institution for insufficient funds or any other error on your part.

EXTERNAL SITES

This Web Site may contain links to other sites on the internet that are operated by parties other than the Company.  The Company is not responsible for the content of any such external sites, or for the availability of such external sites or their content.  If you have questions or concerns regarding the content of any External Site, you should contact the respective External Site administrator directly. 

MISCELLANEOUS

The foregoing terms and conditions and all disputes arising out of your use of this web site or materials from this web site under them shall be governed, construed resolved, and decided in accordance with the laws of the state of Indiana, United States of America, without giving effect to that states' principles of conflicts of law.

UNSOLICITED IDEA SUBMISSION POLICY

Northern Myst Creations or any of its employees do not accept or consider unsolicited ideas, including ideas for new advertising campaigns, new promotions, new products or technologies, processes, materials, marketing plans or new product names.  Please do not send any original creative artwork, samples, demos or other works.  The sole purpose of this policy is to avoid potential misunderstandings or disputes when company's products or marketing strategies might seem similar to ideas submitted to company.  If, despite our request that you not send us your ideas and materials, you still send them, please understand that company makes no assurances that you ideas and materials will be treated as confidential or proprietary.

UNPAID ITEMS

Special order items, or regularly purchased items ordered and unpaid after a period of two days from the date of order will have orders cancelled and items will be restocked.  Northern Myst Creations reserves the right to cancel any order at any time for any reason deemed appropriate by the Company.
